NOTE: this post was published in June of 2016, but it was gone from my post listings when I went looking for it to optimize it. Fortunately, my RSS feed had published it in its entirety. The content is still timely.<\/p>\n

I recently read a suggestion that if we have nothing to hide, we have nothing to fear.\u00a0 To put it another way, if we\u2019re not doing anything wrong, we shouldn\u2019t have a problem with government surveillance. I\u2019d like to offer the following rebuttals in response. \u00a0I don\u2019t have citations immediately available, because this material that I present has been accumulated from many sources over the years. Some came from academic research in the course of my career studies, some from podcasts regarding liberty and public policy, and some from general technology news.<\/p>\n

ENCRYPTION<\/h2>\n

The government really hates the use of encryption for any purpose other than government use. \u00a0Government agents have categorically stated that the use of encryption automatically casts a cloak of suspicion over a user of it. However, encryption \u00a0is necessary for security. Without encryption, no online transactions would be safe to use. You couldn\u2019t access your bank accounts at their websites, you couldn\u2019t perform any commerce transactions. You couldn\u2019t apply for a job online. Well, let me correct that: you COULD, but you would be exposing an awful lot of information to anyone who was able to grab it, and without encryption, anyone could grab it. That means your credit card information would travel across the internet in easy-to-read plain text. Your social security number in an online job application would be available to anyone to see. \u00a0These are things you DON\u2019T want just anyone to see.<\/p>\n

So why would anyone use encryption for any other purpose? Well, the United States federal government considers you to be a suspect if you fall into any of the following categories:<\/p>\n

1.<\/strong>\u00a0Those that talk about \u201cindividual liberties\u201d<\/p>\n

2.<\/strong>\u00a0Those that advocate for states\u2019 rights<\/p>\n

3.<\/strong>\u00a0Those that want \u201cto make the world a better place\u201d<\/a><\/p>\n

4.<\/strong>\u00a0\u201cThe colonists who sought to free themselves from British rule\u201d<\/a><\/p>\n

5.<\/strong>\u00a0Those that are interested in \u201cdefeating the Communists\u201d<\/a><\/p>\n

6.<\/strong>\u00a0Those that believe \u201cthat the interests of one\u2019s own nation are\u00a0separate from the interests of other nations or the common interest of all nations\u201d<\/a><\/p>\n

7.\u00a0<\/strong>Anyone that holds a \u201cpolitical ideology that considers the state to be unnecessary, harmful,or undesirable\u201d<\/a><\/p>\n

8.<\/strong>\u00a0Anyone that possesses an \u201cintolerance toward other\u00a0religions\u201d<\/a><\/p>\n

9.<\/strong>\u00a0Those that \u201ctake action to fight against the\u00a0exploitation of the\u00a0environment and\/or animals\u201d<\/a><\/p>\n

10.<\/strong>\u00a0\u201cAnti-Gay\u201d<\/a><\/p>\n

11.<\/strong>\u00a0\u201cAnti-Immigrant\u201d<\/a><\/p>\n

12.<\/strong>\u00a0\u201cAnti-Muslim\u201d<\/a><\/p>\n

13.<\/strong>\u00a0\u201cThe Patriot Movement\u201d<\/a><\/p>\n

14.<\/strong>\u00a0\u201cOpposition to equal rights for gays and lesbians\u201d<\/a><\/p>\n

15.<\/strong>\u00a0Members of the Family Research Council<\/a><\/p>\n

16.<\/strong>\u00a0Members of the American Family Association<\/a><\/p>\n

17.<\/strong>\u00a0Those that believe that Mexico, Canada and the United States \u201care secretly planning to merge into a European Union-like entity that will be known as the \u2018North American Union\u2019\u201d<\/a><\/p>\n

18.<\/strong>\u00a0Members of the American Border Patrol\/American Patrol<\/a><\/p>\n

19.<\/strong>\u00a0Members of the Federation for American Immigration Reform<\/a><\/p>\n

20.<\/strong>\u00a0Members of the Tennessee Freedom Coalition<\/a><\/p>\n

21.<\/strong>\u00a0Members of the Christian Action Network<\/a><\/p>\n

22.<\/strong>\u00a0Anyone that is \u201copposed to the New World Order\u201d<\/a><\/p>\n

23.<\/strong>\u00a0Anyone that is engaged in \u201cconspiracy theorizing\u201d<\/a><\/p>\n

24.<\/strong>\u00a0Anyone that is opposed to Agenda 21<\/p>\n

25.<\/strong>\u00a0Anyone that is concerned about FEMA camps<\/a><\/p>\n

26.<\/strong>\u00a0Anyone that \u201cfears impending gun control or weapons confiscations\u201d<\/a><\/p>\n

27.<\/strong>\u00a0The militia movement<\/a><\/p>\n

28.<\/strong>\u00a0The sovereign citizen movement<\/a><\/p>\n

29.<\/strong>\u00a0Those that \u201cdon\u2019t think they should have to pay taxes\u201d<\/a><\/p>\n

30.<\/strong>\u00a0Anyone that \u201ccomplains about bias\u201d<\/a><\/p>\n

31.<\/strong>\u00a0Anyone that \u201cbelieves in government conspiracies to the point of paranoia\u201d<\/a><\/p>\n

32.<\/strong>\u00a0Anyone that \u201cis frustrated with mainstream ideologies\u201d<\/a><\/p>\n

33.<\/strong>\u00a0Anyone that \u201cvisits extremist websites\/blogs\u201d<\/a><\/p>\n

34.\u00a0<\/strong>Anyone that \u201cestablishes website\/blog to display extremist views\u201d<\/a><\/p>\n

35.<\/strong>\u00a0Anyone that \u201cattends rallies for extremist causes\u201d<\/a><\/p>\n

36.<\/strong>\u00a0Anyone that \u201cexhibits extreme religious intolerance\u201d<\/a><\/p>\n

37.<\/strong>\u00a0Anyone that \u201cis personally connected with a grievance\u201d<\/a><\/p>\n

38.\u00a0<\/strong>Anyone that \u201csuddenly acquires weapons\u201d<\/a><\/p>\n

39.<\/strong>\u00a0Anyone that \u201corganizes protests inspired by extremist ideology\u201d<\/a><\/p>\n

40.<\/strong>\u00a0\u201cMilitia or unorganized militia\u201d<\/a><\/p>\n

41.<\/strong>\u00a0\u201cGeneral right-wing extremist\u201d<\/p>\n

42.<\/strong>\u00a0Citizens that have \u201cbumper stickers\u201d that are patriotic or anti-U.N.<\/a><\/p>\n

43.<\/strong>\u00a0Those that refer to an \u201cArmy of God\u201d<\/a><\/p>\n

44.<\/strong>\u00a0Those that are \u201cfiercely nationalistic (as opposed to universal and international in orientation)\u201d<\/a><\/p>\n

45.<\/strong>\u00a0Those that are \u201canti-global\u201d<\/a><\/p>\n

46.<\/strong>\u00a0Those that are \u201csuspicious of centralized federal authority\u201d<\/a><\/p>\n

47.<\/strong>\u00a0Those that are \u201creverent of individual liberty\u201d<\/a><\/p>\n

48.<\/strong>\u00a0Those that \u201cbelieve in conspiracy theories\u201d<\/a><\/p>\n

49.<\/strong>\u00a0Those that have \u201ca belief that one\u2019s personal and\/or national \u2018way of life\u2019 is under attack\u201d<\/a><\/p>\n

50.<\/strong>\u00a0Those that possess \u201ca belief in the need to be prepared for an attack either by participating in paramilitary preparations and training or survivalism\u201d<\/a><\/p>\n

51.<\/strong>\u00a0Those that would \u201cimpose strict religious tenets or laws on society (fundamentalists)\u201d<\/a><\/p>\n

52.<\/strong>\u00a0Those that would \u201cinsert religion into the political sphere\u201d<\/a><\/p>\n

53.<\/strong>\u00a0Anyone that would \u201cseek to politicize religion\u201d<\/a><\/p>\n

54.<\/strong>\u00a0Those that have \u201csupported political movements for autonomy\u201d<\/a><\/p>\n

55.<\/strong>\u00a0Anyone that is \u201canti-abortion\u201d<\/p>\n

56.<\/strong>\u00a0Anyone that is \u201canti-Catholic\u201d<\/a><\/p>\n

57.<\/strong>\u00a0Anyone that is \u201canti-nuclear\u201d<\/a><\/p>\n

58.<\/strong>\u00a0\u201cRightwing extremists\u201d<\/a><\/p>\n

59.<\/strong>\u00a0\u201cReturning veterans\u201d<\/a><\/p>\n

60.<\/strong>\u00a0Those concerned about \u201cillegal immigration\u201d<\/a><\/p>\n

61.<\/strong>\u00a0Those that \u201cbelieve in the right to bear arms\u201d<\/a><\/p>\n

62.<\/strong>\u00a0Anyone that is engaged in \u201cammunition stockpiling\u201d<\/a><\/p>\n

63.<\/strong>\u00a0Anyone that exhibits \u201cfear of Communist regimes\u201d<\/a><\/p>\n

64.<\/strong>\u00a0\u201cAnti-abortion activists\u201d<\/a><\/p>\n

65.<\/strong>\u00a0Those that are against illegal immigration<\/a><\/p>\n

66.<\/strong>\u00a0Those that talk about \u201cthe New World Order\u201d in a \u201cderogatory\u201d manner<\/a><\/p>\n

67.<\/strong>\u00a0Those that have a negative view of the United Nations<\/a><\/p>\n

68.<\/strong>\u00a0Those that are opposed \u201cto the collection of federal income taxes\u201d<\/a><\/p>\n

69.<\/strong>\u00a0Those that supported former presidential candidates Ron Paul, Chuck Baldwin and Bob Barr<\/a><\/p>\n

70.<\/strong>\u00a0Those that display the Gadsden Flag (\u201cDon\u2019t Tread On Me\u201d)<\/a><\/p>\n

71.<\/strong>\u00a0Those that believe in \u201cend times\u201d prophecies<\/a><\/p>\n

72. Those that store food beyond two weeks\u2019 worth.<\/p>\n

That is an intimidating list! Notice that very few of these groups of people have much, if anything, to do with radical Islamists. If the surveillance agencies collect enough material, eventually nearly everyone could fall into at least one of these categories, and if material (emails, texts, letters, phone conversations) were collected that \u201cproved\u201d that you fall into more than one of the categories listed above, you could end up on the no-fly list, you could lose a security clearance if you have one, your identity could be flagged and you could be prevented from certain types of work, you could be followed. I don\u2019t care if you have nothing to hide, if you get followed enough, you begin to hate it.<\/p>\n

EFFECTIVENESS<\/h2>\n

Mass surveillance is ineffective in keeping us secure. Surveillance of individual targets is incredibly effective in garnering useful information. Groups of data sets can provide trends and help connect the dots in some amazing ways. But when larger and larger data sets are gathered, even the best software loses effectiveness in drawing lines and connecting trends. The more records there are collected, after a point, the less valuable each record becomes as a piece of security information. The security agencies have justified mass surveillance by saying that they want these records on hand in case they need them. But projects like Prism and KeyScore are collecting so much data\u2013in the case of Prism, ALL OF AT&T DATA NETWORK TRAFFIC\u2013that finding anything of value among all those records would be exactly as easy as finding a needle in the proverbial haystack. So if they were to look for keywords, which keywords should they look for? \u201cBomb?\u201d If you were actually going to bomb a target, would you really put it into an email? Even an encrypted email? Not likely. If the agencies do a massive record search on the word \u201cbomb,\u201d what they\u2019d likely come up with is references to a new song being \u201cda bomb\u201d or a movie that bombed at the box office. And searching that level of record storage, even with a huge computer processing center, would still be so laboriously slow that by the time they found anything they could actually use to build any sort of accurate picture, whatever it was that was happening, would already be past.<\/p>\n

ACCURACY<\/h2>\n

Government doesn\u2019t always get it right. So supposing in several different emails, to different people, maybe several years apart, the agency found an email that confirmed an order for fertilizer, because it\u2019s gardening season. And another time they found a record of a van rental because you were taking a bunch of kids on a field trip. and another time they found a search engine record showing that someone at your house seem extremely interested in a particular historical landmark, because your son was doing a report on that landmark. Prior to the bombing of the Murrah building in Oklahoma City, they wouldn\u2019t have made anything of it. Since that incident, however, surveillance revealing a fertilizer-van rental-landmark connection might send a signal to the agents that you were planning to pull a McVeigh.<\/p>\n

But this example is conjecture. There are documented examples of agents using surveillance and putting the wrong pieces of the puzzle together and coming up with a picture that \u201calmost\u201d makes sense, but which was totally incorrect. The E-Verify system \u00a0of verifying employment eligibility is a prime example of what should be a slam-dunk great system to make sure that only eligible people get to work in America. But there have been many\u2013way too many\u2013false positives on American citizens, who have to spend their own money proving not only that they are American citizens, but that the E-Verify system has falsely flagged the as ineligible to work in the country. And after that happens, there is no recourse for them; the government accepts no responsibility for getting it wrong. Can you not see how objectionable this is?<\/p>\n

SECURITY<\/h2>\n

And here\u2019s another reason we don\u2019t need to trust the government with all our data: The OPM data breach. The Office of Personnel Management suffered the largest data breach of any government agency last year. Millions of records of people directly and indirectly employed in government service had their personally identifiable information compromised. I don\u2019t work for the government, I am employed by a technology services contractor, but my services are leased to the US Army. I had a background check in preparation for this job. So this exposure affects me, AND my husband, AND my kids. So because the OPM didn\u2019t take the proper security precautions (and they have admitted this), millions of records of employees AND their family members have been compromised.<\/p>\n

So I\u2019m not guilty of anything; I just know how these pieces get put together, I know where the surveillance security holes are, and I know that there are way too many things that the government considers fodder for the Enemy List. It\u2019s not that I have anything to hide from the government. The government has taught us through its actions not to trust it with our individual security, and now they’re wondering why we don’t.<\/p>\n
